The New Jersey Department of Environmental Protection (DEP) just announced an emergency adoption of a temporary rule suspension of certain provisions of the Administrative Requirements for the Remediation of Contaminated Sites at N.J.A.C. 7:26C-4, Fees and Oversight Costs.  

Due to the financial uncertainty as a result of the COVID-19 pandemic and the extension of the State Fiscal Year (FY) 2020, the DEP is suspending the requirement to calculate Site Remediation Reform Act and Remedial Action Permitting fees for FY 2021.

The DEP will instead apply the current FY 2020 fees for FY 2021, as published in the June 17, 2019, New Jersey Register at 51 N.J.R. 1069(a). These fees will remain in effect until FY 2022.
