NJDEP Announces Updated Schedules for Registration and Licensing Requirements for Businesses Engaged in Soil & Fill Recycling Services

On September 10, 2021, the New Jersey Department of Environmental Protection (DEP) issued a Compliance Advisory announcing updated deadlines for registration and licensing requirements for business concerns engaged in soil and fill recycling services.

These updates relate to New Jersey’s “Dirty Dirt Law” (S-1683/A-4267), which was signed by Governor Phil Murphy on January 21, 2020 and broadened the DEP’s oversight of businesses engaging in or providing soil and fill recycling services.  The new law imposes stringent compliance requirements within the solid waste industry in an effort to crack down on illegal dumping and other misuse of soils and fill materials throughout the state.

According to the new law, any businesses concern engaged in Soil and Fill Recycling Services as of January 21, 2020 must register with the DEP to acquire an A-901 license.
