What You Need to Know

New Jersey’s Industrial Site Recovery Act (ISRA), formerly Environmental Cleanup Responsibility Act (ECRA), mandates that owners and/or operators of industrial facilities are responsible for the environmental investigation and remediation of their property, and must comply with certain stipulations set by the New Jersey Department of Environmental Protection (NJDEP) prior to the closure, sale or transfer of operations.

What services will Whitman perform?

  • Preparing the initial General Information Notice (GIN), notifying the NJDEP of the ISRA trigger event;
  • Preparing a Preliminary Assessment Report (PAR), which includes a property inspection to identify Areas of Concern (AOCs);
  • Preparing a Site Investigation Report (SIR), if soil and groundwater sampling are deemed necessary at any AOC;
  • Preparing a Remedial Investigation Report (RIR) if further sampling was necessary to evaluate any AOC;
  • Preparing a Remedial Action Work Plan (RAWP) if remediation is required for any AOC;
  • Preparing a Remedial Action Report (RAR) if remediation was conducted for any AOC;
  • Issuing a Response Action Outcome (RAO) letter for the facility, indicating all AOCs have been addressed and closed by the LSRP.
  • Preparing a Remediation Certification and associated Remediation Funding Source calculation, which is a mechanism to allow a transaction to proceed prior to obtaining an RAO.
