On March 25, 2020, the New Jersey Department of Community Affairs (NJDCA) announced an emergency adoption of a temporary rule relaxation of certain regulatory provisions under the Uniform Construction Code (UCC) concerning Minor work (N.J.A.C. 5:23-2.17A), Inspections (N.J.A.C. 5:23-2.18), and Certificate requirements (N.J.A.C. 5:23-2.23).

The Notice of Rule Waiver/Modification/Suspension was issued pursuant to Executive Order 103 as a direct response to the COVID-19 pandemic, authorizing agency heads to waive, suspend or modify any existing rule where the enforcement of the rule would be a detriment to public welfare, thereby ensuring the continuity of construction activities during this state of emergency.

The NJDCA also issued a Memo which provides guidance to construction offices explaining these rule modifications and how to implement the changes.  The operational guidance for construction offices varies based on whether or not the office is open during the pandemic.
