New Jersey and New York facilities in certain industrial classifications, defined by North American Industry Classification System (NAICS) Codes, are required to submit an annual Community Right-to-Know Survey (CRTK Survey/Tier II Report). Pennsylvania facilities are required to post a Hazardous Substance Survey Form in their respective workplaces annually.

This is in addition to OSHA’s Hazard Communication Standard which requires employers to establish hazard communication programs to transmit information on the hazards of chemicals to their employees by means of labels on containers, material safety data sheets and training programs. Implementation of these hazard communication programs will ensure all employees have the “right-to-know” the hazards and identities of the chemicals they work with, and will reduce the incidence of chemically-related occupational illnesses and injuries.

Important Dates

The CRTK Survey/Tier II Report for the year 2017 is due by:

  • March 1, 2018 — NJ private employers
  • July 15, 2018 — NJ public employers
  • March 1, 2018 — NYC & NY State businesses
  • March 1, 2018 (suggested) — PA private and public employers

Many facilities do not submit the annual CRTK Survey because they either believe they are exempt from reporting requirements or they have difficulty setting up their online account to submit a CRTK Survey.
